PRE-EXISTING CONDITIONS
TBP shall not be held responsible for any damage, leakage, overflow, backup, stoppage, or malfunction caused by pre-existing defective, worn, deteriorated, obstructed, improperly installed, or non-code-compliant plumbing, fixtures, appliances, or related components not specifically repaired or replaced by TBP. Existing conditions may not be apparent prior to, during, or immediately after service. Unless expressly stated in writing, TBP makes no representation or warranty as to the condition or continued performance of any existing plumbing system, fixture, appliance, or component. Any additional repairs required due to pre-existing conditions shall be at the owner/authorized agent’s expense.
DISCLOSURE OF KNOWN PLUMBING CONDITIONS
Owner/authorized agent is responsible for disclosing any known or suspected plumbing issues that may affect diagnosis, service, or repair. TBP is not responsible for damages, delays, or additional repairs resulting from undisclosed conditions. Any additional work required due to such conditions will be presented as additional work and charged accordingly.
CABINET ACCESS / REMOVAL
To facilitate plumbing repair, TBP will need to either remove or access your cabinet. Should any removal or modifications be necessary, TBP recommends that a competent carpenter be sought for both removal and reset. Upon your request, TBP may commit to the removal and/or reset of your cabinets; however, TBP is not responsible for paint, wall covering, drywall or cabinet repair.
DRYWALL ACCESS
To facilitate plumbing repair, the drywall must be accessed. Although, TBP will utilize care and discretion when
Accessing plumbing thru the drywall, any repair costs for damages to any hidden utilities will be the owner/authorized agent's responsibility. TBP is not responsible for replacement/repair of any drywall or wall coverings.
EXCAVATION
To facilitate plumbing repair, the ground must be excavated. Upon completion of repairs, a uniform mound will be formed
atop the previously excavated area(s). Any residual debris will be hauled away from the premises. Any additional charges for repairs to
underground utilities will be made at the owner/authorized agent's expense. TBP is not responsible for landscaping.
TBP is not responsible for ground settling or foundation repairs.
FOUNDATION PENETRATION
TBP does not recommend slab penetration if other prudent options for access are available. Many modern slab
foundations contain post tension cables and/or other utilities (refrigerant lines, electrical lines, HVAC ducts, etc.). TBP is not responsible for damage to said utilities. Although reasonable efforts will be made to avoid damaging such obstacles, any necessary repairs hereto will be the owner/authorized agent's responsibility.
Upon completion of the plumbing repair (and municipal inspection if required), the penetration will be prepared for pour
back. Concrete will be back poured up 1/4" of grade to allow for proper floor floating prior to installation of the finished
floor. Upon your request, TBP can float the concrete to grade; however, TBP does not guarantee a perfectly level surface. TBP is not responsible for floor covering replacement.
MASONRY REMOVAL / ACCESS
To facilitate plumbing repair, masonry must be accessed or removed. TBP will attempt to preserve bricks or stone
during removal; however, TBP is not responsible for masonry repair.
SIDEWALK or DRIVEWAY ACCESS
To facilitate plumbing repair, the sidewalk or driveway must be accessed. TBP will use an industrial grade concrete
saw and demolition equipment to provide a clean and uniform cut. Upon completion of plumbing repair, the area will be
backfilled and be prepared for back pour. Whenever concrete is back poured next to existing concrete, differences in color
and texture should be expected. TBP is not responsible for future expansion and or settling of the concrete. Once
the concrete is poured and floated, TBP is not responsible for graffiti, footprints or contaminants that may negatively
affect structural integrity or aesthetics.
TILE REMOVAL
To facilitate plumbing repair, tiles may need to be chipped and/or removed. TBP will attempt to preserve the tile during removal; however, TBP is not responsible for tile or drywall repairs or replacement.
TOILET REPLACEMENT
It is common construction practice that toilets be installed after the finished floor is fully installed. Floor coverings are installed to the closet riser (vertical drain pipe) and then a flange (onto which the toilet is bolted) on top of the riser. Occasionally, we find the floor covering was installed to the toilet itself. This may create aesthetic problems if the new toilet base differs physically from the previous one. Some manufacturers may change their base configuration, despite retaining the same model and part number. TBP does not guarantee new toilets to match the base configuration of the previous; therefore, unsightly floor covering can occur.
Additionally, upon removal of your existing toilet, we may discover the flange or closet riser to be defective. Because we are unable to evaluate the condition prior to the toilet's removal, should additional repairs be needed, additional charges will be presented before providing further services.
EXCLUSIONS
Any charges from an engineer are excluded from this agreement, should the owner require engineering services. Any damage to the foundation or structure of the building from any excavation, penetration through the floor or pressure filling are not warranted. Any foundation penetrations will be made at the written direction of the owner/owner's agent or owner's engineer (if applicable). Although residual dust will be minimized, any services to remove residual dust are excluded from this agreement. As with any type of excavation when the ground is opened and excavation is started, unforeseen and unusually hard materials may be encountered. We reserve the right to adjust the charges accordingly if digging problems are encountered (rocks or other materials blocking the dig). Any repairs resulting from damages to underground utilities will be made at the owner's expense. Landscaping or the replacement thereof is excluded from this agreement. In residential applications, a uniform mound will be formed along the trench line which is expected to settle; however, ground settling is excluded from this agreement. Repair to or replacement of any drywall, masonry, siding or other materials accessed for plumbing repairs are excluded from this agreement unless otherwise specified in writing. Should it be determined upon exposure that a water tight and sanitary repair can not be made, any charges for work already completed will be invoiced and an addendum will be submitted. Loss of revenue due to delay in business is excluded from this agreement. Any existing warranties that may become null and void due to the repairs outlined above are excluded from this agreement. It is anticipated that quality materials will be used and installed in accordance with applicable plumbing codes. However, should subsequent piercing, leveling or stabilization of the structure occur, any implied warranties shall become null and void. Any damage or delays due to unavailability of materials, strikes or Acts of God are excluded from this agreement.
AUTHORIZATION
I hereby authorize the work described on the above to be completed and an express mechanic's lien is acknowledged on the referenced property to secure the amount of repairs thereto. Furthermore, by signing this agreement I hereby acknowledge that I have read and understand the above mentioned exclusions and disclosures.
